Agreement to Terms

By accessing and using the Artimusin Digital Solutions website and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Use License

Permission is granted to temporarily download one copy of the materials on Artimusin Digital Solutions' website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the materials
  • Use the materials for any commercial purpose or for any public display
  • Attempt to reverse engineer any software contained on the website
  • Remove any copyright or other proprietary notations from the materials

Services

Web Development Services

We provide custom web development services including but not limited to website design, web application development, e-commerce solutions, and content management systems.

Mobile App Development Services

We develop native and cross-platform mobile applications for iOS and Android platforms, including design, development, testing, and deployment services.

Cloud Solutions Services

We provide cloud infrastructure design, implementation, and management services using various cloud platforms, primarily Amazon Web Services (AWS).

Project Terms

Project Scope and Timeline

All projects will be governed by a separate project agreement that outlines specific deliverables, timelines, and payment terms. Changes to project scope may result in additional costs and timeline adjustments.

Client Responsibilities

Clients are responsible for:

  • Providing accurate and complete project requirements
  • Supplying necessary content, assets, and access credentials
  • Timely review and feedback on deliverables
  • Payment according to agreed terms
  • Compliance with applicable laws and regulations

Intellectual Property

Upon full payment, clients will own the custom code developed specifically for their project. However, we retain ownership of:

  • Pre-existing intellectual property and frameworks
  • General methodologies and know-how
  • Any improvements to our existing tools and processes

Payment Terms

  • Payment schedules will be outlined in individual project agreements
  • Late payments may incur additional fees
  • Disputed invoices must be raised within 30 days of receipt
  • We reserve the right to suspend work for overdue payments

Warranties and Disclaimers

We warrant that our services will be performed in a professional manner consistent with industry standards. However, we make no other warranties, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.

Limitation of Liability

In no event shall Artimusin Digital Solutions be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Support and Maintenance

Post-launch support and maintenance services are available under separate agreements. We provide a warranty period for bug fixes as specified in individual project contracts.

Confidentiality

We respect the confidential nature of our clients' business and will not disclose any confidential information without prior written consent, except as required by law.

Termination

Either party may terminate a project agreement with written notice. Termination terms, including payment for completed work and return of materials, will be outlined in individual project agreements.

Force Majeure

Neither party shall be liable for any failure or delay in performance due to circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, or government actions.

Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the jurisdiction where Artimusin Digital Solutions is incorporated, and you irrevocably submit to the exclusive jurisdiction of the courts in that state or location.

Privacy Policy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of our services, to understand our practices.

Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of any changes.

Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining terms shall remain in full force and effect.
